Welcome to Rolify AI Character Chat These Terms of Service ("Terms") govern your access to and use of the Rolify AI Character Chatmobile application and website (collectively, the "Application"), provided by HRY GROUP BILISIM INSAAT SANAYI TICARET ANONIM SIRKETI (hereinafter referred to as "Service Provider" or "we", "us", or "our"). By accessing or using the Application, you agree to be bound by these Terms and all policies referenced herein. If you do not agree to these Terms, you may not use the Application.

1. Acceptance of Terms

By downloading, installing, or using the Rolify AI Character ChatApplication, you signify your agreement to these Terms of Service. These Terms apply to all visitors, users, and others who access or use the Application. Your continued use of the Application signifies your acceptance of any revisions to these Terms.

2. Eligibility

You must be at least 13 years old to use the Application. If you are under 18, you represent that you have reviewed these Terms with your parent or guardian and that they agree to these Terms on your behalf. We do not knowingly collect personal information from children under 13.

3. User Accounts

To access certain features of the Application, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and identification.
• Maintain and promptly update your registration data, and any other information you provide to the Service Provider, to keep it accurate, current, and complete.
• Be solely responsible for all activities that occur under your account.

4. User Content

You are solely responsible for the content you create, share, store, or submit to the Application ("User Content"), which may include photos, videos, text, and other media.

• Ownership: You retain all ownership rights to your User Content.
• License: By submitting User Content, you grant the Service Provider a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Application and the Service Provider's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Application (and derivative works thereof) in any media formats and through any media channels.
• Prohibited Content: You agree not to post, upload, transmit, distribute, store, create, or otherwise publish through the Application any of the following:
  • Content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable.
  • Content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, state, national, or international law.
  • Content that may infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party.
  • Private information of any third party, including addresses, phone numbers, email addresses, Social Security numbers, and credit card numbers.
  • Viruses, corrupted data, or other harmful, disruptive, or destructive files.

5. Intellectual Property Rights

The Application and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of HRY GROUP BILISIM INSAAT SANAYI TICARET ANONIM SIRKETI and its licensors. The Application is protected by copyright, trademark, and other laws of both the Republic of Turkey and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Service Provider.

6. Prohibited Uses

You agree not to use the Application:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
• To impersonate or attempt to impersonate the Service Provider, a Service Provider employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Application, or which, as determined by us, may harm the Service Provider or users of the Application or expose them to liability.
• To introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Application, the server on which the Application is stored, or any server, computer, or database connected to the Application.

7. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Service Provider makes no representations or warranties of any kind, express or implied, as to the operation of the Application or the information, content, or materials included therein. You expressly agree that your use of the Application is at your sole risk.

To the fullest extent permissible by applicable law, the Service Provider disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The Service Provider does not warrant that the Application, its servers, or emails sent from the Service Provider are free of viruses or other harmful components.

8. Limitation of Liability

In no event shall the Service Provider, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Application; (ii) any conduct or content of any third party on the Application; (iii) any content obtained from the Application; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Indemnification

You agree to defend, indemnify, and hold harmless HRY GROUP BILISIM INSAAT SANAYI TICARET ANONIM SIRKETI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Application, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Application.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

11. Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity or termination, shall be referred to and finally resolved by the competent courts in Turkey.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Application after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Application.

13. Termination

We may terminate or suspend your account and bar access to the Application immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Application. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
